Terms and Rules for India Ka Apna Game Contest

GENERAL

• These Terms (as defined herein) govern the conduct of the contest titled “#Indiakapanagame” (hereinafter referred to as the “Contest”) organized, conducted, and brought to you by Cashgrail Private Limited (hereinafter referred to as “Cashgrail” or  “Company”).
• You agree and acknowledge that you have completely read and understood these terms and conditions (hereinafter referred to as the “Contest T&C”) , Terms and Conditions (applicable provisions) and Privacy Policy, (hereinafter collectively referred to as the “Terms”), incorporated herein by reference, as amended from time to time. You agree, covenant, and undertake to be bound by the Terms and all other rules, regulations, and terms of use referred to herein or provided by Company in relation to the Contest.
• Entry and participation in this Contest will be deemed as an unconditional and an unequivocal acceptance of the Terms, including any modifications, revisions, and amendments thereto.

ELIGIBILITY

• Participation in this Contest is voluntary.
• Participants below the 18 (eighteen) years of age are not allowed to participate in the Contest.
• The Contest is open to all citizens of India only but excludes employees and the family members of the Cashgrail, its associate companies, its advertising, and promotional agencies and its auditors / executing agencies, or anyone else professionally connected with the Cashgrail.
• The Contest is not directed towards, open to or intended for, or meant for the usage or participation of any person within the territorial limits of the State of Odisha, Andhra Pradesh, Arunachal Pradesh, Assam, Meghalaya, Telangana, Nagaland, Tamil Nadu and Sikkim or any other State within the territory of India restricting gaming activity or such advertisement.

CONTEST

• Contest Name: Mehfil-e-Ludo
• Contest Period: This is a limited period contest to held for period of 5 (five) days which starts at 5th July, 2023 and ends at 12th July, 2023 (hereinafter referred to as the “Contest Period”).
• Cashgrail reserves the right, at any time, to verify the validity of entries and participants (including a participant’s identity, age, and place of residence) and to disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
• Rules of the Contest:

  • You must have uploaded all our contest posts on your stories tagging us.
• Prizes: During the Contest Period, winner(s) on the basis of valid participation as per the Terms, shall be eligible to win the following Prize(s):

• Company reserves the right to reject any participants’ entry without the need to notify the participant of the reasons for rejection.
• Non-conformance by the Participants to any and all the rules will make such Participant’s entry(ies) null and void. Any forfeiture exercised by the Company will be binding and final on the Participants.
• The Company reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter, suspend or modify this Contest or any part thereof, including but not limiting to the Contest Period, eligibility and participation criteria, etc. It shall be the sole responsibility of the participants to check the rules and regulations of the Contest on the Company’s website.
• The winner will be contacted by the representatives of the Cashgrail through Direct Message on his/her Social Media Profile which was used for participation in the contest via Company’s official ID only i.e. https://www.instagram.com/zupee_official/?hl=en to collect the documents like proof of ID, Age as required against a receipt and verify the claim before redeeming the prize. Award of prizes is subject to the verification of documents by the Auditor. After verification, the prize winner will be informed about the entire process of redemption of the prize.
• The winners will have to revert back within 10 (ten) days of the Cashgrail reaching out to them for their details, failing which the winners will not be gratified. In case the winner fails to claim the prize(s) or fails to furnish the details/documents on or before the time period communicated by the Company or declines to accept delivery of the Prize(s), the Company shall be entitled to forfeit  the Prize and cash or any monetary benefits in kind shall not be awarded in lieu of such Prize.
• Entries received after the participation dates shall not be entertained and shall be considered ineligible for the Contest.
• Cashgrail assumes no liability or responsibility for (i) any errors, omissions, or inaccuracies of content or submissions, (ii) Any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information that may be contained therein. (iii) Any deletion of data or interruption or discontinuance of transmission to or from or through the Promotion.
• Each participant must be careful in providing their information. In case the participant provides inaccurate and false information, the entire prize would be forfeited or will be passed on to another participant without any further communication with the claimant. The Cashgrail shall have the sole discretion in this regard.
• It is clarified that in case the winner becomes disqualified on account of any Government restriction, winner regulations, norms, policy, etc., in such case Winner shall not have any claim against Cashgrail for the same and shall be deemed to have waived of his/her prize.
• Decisions of the Cashgrail will be final and binding with regard to the contest and prizes and no correspondence shall be entertained in this regard.
• Entries are deemed to be submitted at the time of receipt of the entry into the Cashgrail database, and not at the time of transmission by the participants. The database maintained by the Cashgrail shall be considered final and no correspondence in this regard shall be entertained.
• Notification of the Winner status must be kept confidential until the Winners are publicly revealed by the Cashgrail or the Winner prize will be forfeited.
• The Prize(s)/rewards cannot be transferred, negotiated, refunded, or exchanged and only the winner(s), shall be entitled to claim the Prize/rewards and no other person or agent is authorized to claim the Prize/rewards on the winner’s behalf.
• Any costs or expenses incurred to participate in the contest and/or to claim the Prize, if any, shall be solely borne by the Winner. Company shall not be liable for any such costs or expenses.
• Cashgrail shall not be liable for any direct or indirect loss or damage whatsoever that may be suffered as a result of participating in this contest or any media content uploaded by such participant(s).
• In case of dispute, the Cashgrail decision is final and no correspondence will be entertained.
• The Cashgrail reserves the right in its sole and absolute discretion to alter any contest rules at any time.
• The participant(s) expressly warrants that he/she shall not upload any content which belongs to any other person or to which the participant does not have any right; or is defamatory, obscene, pornographic, pedeophilic, invasive of privacy of any person, insulting or harassing on basis of gender, racially or ethnically objectionable, or otherwise inconsistent with or contrary to laws in force in India. The participant(s) expressly bind themselves to indemnify Cashgrail and authorize Cashgrail to recover such losses which may be suffered by Cashgrailas a result of the breach of these terms and conditions.
• The Company reserves the right, in its sole discretion, to change/ cancel/delay the Prize(s) at any time without liability. In the event of Contest cancellation, participant(s) shall not be eligible for any Prizes or rewards. participant(s) acknowledge and agree that the Company shall not be held liable for any losses, damages, or expenses incurred as a result of cancellation, change or delay.
• The decision of the Company with respect to the awarding of Prizes shall be final and binding.
• The Prizes shall be provided to the winners on an “as-is basis” and without any warranty or guarantee concerning the quality, suitability, merchantability or comfort, and Company and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiencies, shortcomings, faults, inadequacy, insufficiencies and/ or defects of any product/service and/or the Prize or for any kind of consequential damages/ loss, in any manner whatsoever. The guarantee and warranty of the Prizes shall be transferred to the winners as received from the builder/manufacturer/distributor/retailer/procurement agency.
• The Company shall not be responsible for resolving any issues in respect of non-delivery, deficiency, shortcomings, faults, inadequacy, insufficiencies and/ or defects in any way.
• The winner(s) will not be entitled to exchange, assign or request for any changes in the Prizes offered.
• No Prize will be awarded if the information furnished by the participant(s) at the time of entering the Contest, or at any subsequent stage is factually incorrect.
• In the event of death of the winner, no claim from the nominee or his/her legal heirs shall be entertained for receiving the Prizes. However, the Company shall have the right to call for such documentary evidence before handing over the prize to the legal heirs/successors.
• No request for upgrade or change in make, model, color, specifications etc. or any other features of the Prize(s) shall be entertained.
• Participant(s) agree that the Company shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize(s).
• The Prize(s) to the winners shall be given subject to compliance with all applicable laws, processes, or formalities in connection with the Prize(s) and on production of all such documents/papers as may be required by the Company before accepting the delivery of the Prize(s). Any failure on the part of the winners to comply with directions issued by the Company,  for claiming of Prize shall entitle the Company to forfeit the Prize(s) and the Prize shall be rolled over to the next eligible winner, at the sole discretion of the Company.
• The determination of the delivery location for the Prizes shall be at the sole discretion of the Company.

INVOICES, TAXATION AND OTHER CHARGES

• Invoices or other documentation like warranty card, participant manual etc.: Where required due to administrative convenience, invoices and other documentation related to Prizes sought to be distributed shall be in the name of the winner. In all other cases, the said invoices shall be issued in the name of the Company. 
• Impact of taxes & other charges/ levies applicable on the purchase of gifts
  • The impact of taxes and other charges/ levies applicable on the purchase and procurement of the Google Pixel shall solely be on the winner’s account. In other words, all the applicable regulatory and statutory duties and taxes, surcharge, insurance, transfer fees, levies, other incidental costs and charges mentioned on the invoice shall be borne by the winner(s).
  • The taxes or levies on BoAt smart watches , shall be borne by the Company.

• Requirement to deduct taxes on Prizes sought to be distributed to winners.
  • As per the applicable taxation laws, appropriate taxes are required to be deducted (also referred to as ‘TDS’) by the Company at the time of distribution of Prizes in cash or in kind.
    • Cash Rewards: In case the Company extends  cash reward in lieu of kind rewards in its sole and absolute discretion, the applicable TDS and other statutory levies in accordance with the applicable laws shall be deducted before handing over the prizes.
    • Kind Rewards (Google Pixels): In case the participant will opt to obtain Prizes in kind, the distribution of Prize(s) by the Company shall be subject to the deposit of required taxes by the winner and share the challan with us, for discharging the responsibility of the Company.
    • BoAt Smart Watches: For winners getting the Prize in the form of BoAt smart watches, required taxes will be borne and deposited by the Company.

• Requirement to obtain PAN: To claim any Prizes or rewards in kind, all winners must provide a valid PAN, regardless of the value of the Prize. Failure to furnish a valid PAN or other necessary documents (which shall be communicated before distribution of Prizes) will result in forfeiture of the Prize or reward at the sole discretion of the Company.

PUBLICITY

• Acceptance of Prize(s) by the winner, constitutes permission for Company and its affiliates to use the winner’s name, likeness, voice, photo, audio-visual and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and/or additional compensation whatsoever. The winners further undertake that they will be available for promotional purposes as planned and desired by the Company without any charge. Promotional activities may include but not be limited to press events, internal meetings, social media and ceremonies/functions.

OTHER TERMS AND CONDITIONS

• The Company reserves the right to cancel or terminate the Contest at any stage without assigning any reasons whatsoever. Successfully entering the Contest and winning a Prize is subject to all requirements set forth herein or communication at the time of the registration for the Contest.
• Company shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the Prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the participant in these circumstances.
• Company shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.
• Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of the Company.
• Company accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted, or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. The Company shall not be liable for any consequences of participant error including (without limitation) costs incurred.
• If a participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with the Terms, his/her sole and exclusive remedy is to not participate in the Contest.
• The Company is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to participant’s or any other person’s mobile handset, or computer related to, or resulting from, participation in this Contest or the downloading of any materials related to this Contest.
• Caution: Any attempt to deliberately damage the Company’s Contest Website or the information on the Contest Website, to cause malicious damage or interference with the normal functioning of the Contest Website, or to otherwise undermine the legitimate operation of this Contest may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Company reserves the right to seek damages to the fullest extent permitted by law. If the Company suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by a participant, the participant agrees to indemnify the Company for those losses, damages, and costs.
• The Company, its clients, agents, and distributors accept no responsibility, financial or otherwise for the misuse of the Prize(s)and are not liable for any personal loss or injury and cannot be held responsible for any disagreement concerning quality/ availability of the Prize(s).
• This document is an electronic record in terms of the Information Technology Act, 2000 and rules there under as applicable and various other statutes. This electronic record is generated by a computer system and does not require any physical or digital signatures.
