Terms and Conditions – Rewards Scheme

Cashgrail Pvt. Ltd. (hereinafter referred to as “Zupee”, “Company”, “We”, “Our”, “Us”) is introducing a limited time Rewards Scheme (“Scheme”) (“Scheme Period”), wherein each registered user of the Platform (hereinafter referred to as “You”, “Your” or “User”) gets an opportunity to receive certain cashbacks and rewards from Zupee while engaging with games on the Platform, subject to the terms mentioned below (“Scheme Policy”).

Except as specifically set out under this Scheme Policy, the terms of use, at https://www.zupee.com/terms-and-conditions/ (“Terms of Use”) shall apply mutatis mutandis to this Scheme Policy. The capitalized terms not defined under this Scheme Policy shall have the same meaning as assigned under the Terms of Use.

This Scheme applies exclusively to registered Users, above the age of 18 (eighteen).

Scheme Rewards
1. Users who successfully win contests on the Platform as per the rules displayed on the Platform, may be eligible for certain free rewards on the Platform (collectively “Scheme Rewards”):
Terms for Kind Prizes
1. The prizes/rewards shall be provided to the winners on an 'as-is basis' and without any warranty or guarantee concerning the quality, suitability, merchantability or comfort, and Zupee and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiencies, shortcomings, faults, inadequacy, insufficiencies, accidents/injury, harm and/ or defects of any product/service and/or the prize or for any kind of consequential damages/ loss, in any manner whatsoever. The guarantee and warranty of the prizes, if any, shall be transferred to the winners as received from the builder/manufacturer/distributor/retailer/procurement agency.
2. Zupee shall not be responsible for resolving any issues in respect of non-delivery, deficiency, shortcomings, faults, inadequacy, insufficiencies, injuries, accidents and/ or defects in any way. If any User has any grievance with respect to the prize in kind, he/she may directly contact the builder/manufacturer /distributor/retailer/procurement agency/service provider.
3. The image of the rewards/prize depicted on the press ads/posters/TVC's/digital ads/videos/ promotional materials/advertisements or any other depictions made etc. are for illustrative purposes only and the actual prize(s) may vary from the depiction made.
4. User(s) agree that the Company shall not be liable for any claims, costs, injuries, losses, harm or damages of any kind arising out of or in connection with the Reward Scheme, prizes (in kind) or with the acceptance, possession, or use of any prize(s).
5. The prizes are subject to availability and can be altered or modified at the sole and absolute discretion of the Company. The Company reserves the right to vary and disburse the prizes in form of cash instead of the prize specified in kind in the User Terms. The monetary value of the prize in kind shall be determined by the Company, in its sole discretion.
6. In case of a tie between the winners, the monetary value of prizes will be clubbed and accordingly split based on the number of winners. In such cases, the Prizes in kind shall not be awarded and the winners will only be entitled to cash rewards post splitting. Further, the monetary value of such clubbed prize(s) will be determined in sole and absolute discretion of the Company.
7. Winners are required to claim the prize(s) within a period of 7 (seven) days from the date of declaration of the winners by the Company. In case the winner fails to claim the prize(s) or fails to furnish the details/documents on or before the time period communicated by the Company or declines to accept delivery of the prize(s), the Company shall be entitled to forfeit the prize and cash or any monetary benefits in kind shall not be awarded in lieu of such prize in kind.
8. In the event that a winner opts for a prize in kind or cash, this choice is final and irrevocable, prohibiting any substitution or exchange for cash or other compensation/prize in kind. The winner shall be obligated by their exercised choice. Notwithstanding the foregoing, the Company reserves the right, at its sole discretion, to alter, substitute, or amend the prize without prior notice.
9. In the event that the prize is damaged, lost, or stolen, the winner shall bear full responsibility for coordinating any necessary insurance claims, recovery processes, or related matters. The Company shall not be held liable for any damage, loss, or theft of the prize that occurs. The Company shall not be liable for any financial or legal responsibility for the outcome of such claims. By accepting the prize, the winner acknowledges and agrees to these terms and waives any right to pursue any claim against the Company for any transit-related issues.
10. The Company shall have the exclusive authority to determine the specific location(s) for the delivery and procurement of the prizes awarded to winners, at the sole discretion of the Company. This determination shall be based on logistical considerations, availability of the prize, and other relevant factors, as deemed appropriate by the Company.
11. Prizes in kind will be made available only after the User furnishes the correct details/documents as required by the Company.
12. The timelines for delivery of the Prizes shall be subject to availability and the said timelines can be extended as per the sole discretion of the Company.
13. The prize(s) to the winners shall be given subject to compliance with all applicable laws, processes, or formalities in connection with the prize(s) and on production of all such documents/papers as may be required by the Company before accepting the delivery of the prize(s). Any failure or breach on the part of the winners/User to comply with directions issued by the Company, for claiming of prize shall entitle the Company to forfeit the prize(s) at the sole discretion of the Company.
14. The delivery of the prize(s) is contingent upon the winners providing accurate address details and their availability at the specified location. If, for reasons beyond the control of the Company, the prize(s) cannot be delivered within the designated time frame, the winners will be required to collect the prize(s) from a nearby location specified by the Company. However, any expenses incurred in this process, including travel, accommodation, collection of prizes or other related costs, shall be solely borne by the winners.
15. The winners will be subjected to KYC verification before handing over the prize(s).
16. Requirement to deduct taxes on Prizes sought to be distributed to winners: As per the applicable taxation laws, appropriate taxes are required to be deducted (also referred to as ‘TDS’) by the Company at the time of distribution of Prizes in cash or in kind.
  1. Rewards: In case the user will opt to obtain cash reward, the applicable TDS provisions are provided as detailed in the Terms and Conditions.
  2. Prizes in kind: In case the user opts for Prizes in kind, the TDS on Prizes in kind shall be borne by the Company.
  3. The User acknowledges that Zupee may deduct TDS from any Scheme Rewards disbursed to the User, if required as per applicable law. Users are expected to discharge all other compliances including their taxation obligations vis-à-vis the Scheme Rewards on their own and Zupee shall not be held liable on account of a User’s failure to discharge such obligations.
Requirement to obtain PAN.
1. To claim any prizes or rewards in kind, all winners must provide a valid PAN, regardless of the value of the prize. Failure to furnish a valid PAN or other necessary documents as may be required by the Company (which shall be communicated before distribution of Prizes) will result in forfeiture of the prize or reward at the sole discretion of the Company.
2. The Company reserves the right to charge a nominal processing fee as determined from time to time, for managing the logistics vis a vis disbursement and distribution of the prizes in kind.
3. The failure to furnish these documents can result in forfeiture of the Scheme Rewards at the sole discretion of Zupee. By providing these additional documents and information to Zupee, the User consents to the use of this information shared for the purposes of facilitating the Scheme Rewards including but not limited to Zupee sharing these documents and information with third-party partner brands for the purpose of availing the Scheme Rewards.
Miscellaneous
1. Users acknowledge and agree that they are not assured to win any Scheme Rewards and that the Zupee has made no assurances regarding the probability of winning any prize.
2. The Scheme is made purely on a ‘best effort’ basis and participation in this Scheme is voluntary and at your sole discretion and risk. By participating in the Scheme, the User is legally bound to release from liability, and hold Zupee harmless and any of its affiliates, employees or agents for any matters in relation to the Scheme.
3. Each User can participate in the Scheme only through their registered accounts. All entries to each gameplay must be made by the User themselves. The creation of multiple accounts, employing unfair means (including but not limited to hacking, unauthorised access, entry by proxy) or any attempt to obtain additional Scheme Rewards fraudulently shall result in immediate disqualification and forfeiture of any Scheme Rewards earned by the User through any account.
4. Users agree to provide true, accurate, current and complete information at the time of registration and at all other times, as may be required by the Company. Company reserves the right to reject any Users’ entry without the need to notify the User of the reasons for rejection.
5. The Company reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter, suspend, or modify this Contest or any part thereof, including but not limiting to the Contest Period, eligibility, and participation criteria, etc. It shall be the sole responsibility of the Users to check the rules and regulations of the Contest on the Company’s website and the application.
6. Users acknowledge that Scheme Rewards are non-exchangeable, non-transferable and not redeemable. Users acknowledge that Zupee disclaims all responsibility and liability associated with the Scheme Rewards wherever issued by third parties, including without limitation, any warranties associated with such Scheme Rewards and/or additional costs associated with such Scheme Rewards.
7. Company shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Reward Scheme due to any government restrictions.
8. If a User is dissatisfied with the Reward Scheme or the Reward Scheme rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with the Terms of Use, his/her sole and exclusive remedy is to not participate in the Reward Scheme.
